1. Introduction

Welcome to LegacyPass, a product of ITRUSTLEGACY LTD. These Terms & Conditions ("Terms") govern your use of the LegacyPass app (“the App”) available on Android and iOS platforms, and our website at www.LegacyPass.app (“the Website”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Eligibility

LegacyPass is available to users worldwide. While there is no specific age restriction to access certain features, users under 18 years old must obtain parental or guardian consent to register and use LegacyPass. If you are under 18, you must ensure that your parent or legal guardian reviews and agrees to these Terms on your behalf.

3. Account Registration

To use LegacyPass, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, please contact us immediately.

4. Software License and Usage

4.1 License Grant

Subject to your compliance with these Terms, ITRUSTLEGACY LTD grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

4.2 License Restrictions

You agree not to, and will not permit others to:

  • Copy, modify, or create derivative works of the App.

  • Reverse engineer, decompile, or disassemble the App, except as expressly permitted by law.

  • Rent, lease, lend, sell, sublicense, or redistribute the App.

  • Use the App to infringe the rights of ITRUSTLEGACY LTD or any third party.

4.3 Ownership

All intellectual property rights in the App and Website, including but not limited to software, designs, logos, and trademarks, are owned by ITRUSTLEGACY LTD or its licensors. These Terms do not grant you any rights to use such content, except as expressly provided in this agreement.

5. Subscription Plans

LegacyPass offers various subscription plans, including free and paid options. The specific features and benefits of each plan are detailed within the App and on the Website. Subscription plans may be subject to change, and LegacyPass reserves the right to modify or discontinue any plan at its discretion.

5.1 Payments

LegacyPass subscription plans are currently available for purchase only through the website. A variety of payment methods are available to suit your needs. In-app purchase options will be introduced in the future.

5.2 Subscription Renewal and Cancellation

Your subscription will automatically renew at the end of each billing period unless you cancel it through your account settings. You may cancel your subscription at any time, but please note that cancellations will take effect at the end of your current billing period. You will not receive a refund for the remaining period of your subscription after cancellation.

5.3 Refund Policy

Refunds for subscription fees are generally not available, except as required by applicable law. However, if you believe there has been an error in billing, please contact us within 14 days of the charge for resolution.

6. Use of the Service

6.1 Personal Use Only

LegacyPass is intended for personal use only. You may not use the App or Website for any commercial purpose without our prior written consent.

6.2 Prohibited Activities

You agree not to use LegacyPass to:

  • Violate any applicable laws or regulations.

  • Infringe upon the rights of others, including intellectual property rights.

  • Distribute harmful or malicious software.

  • Interfere with or disrupt the functionality of the App or Website.

  • Upload or share any NSFW content, including but not limited to pornography, terrorism, gore, or similar materials.

  • Violate the principles of security, privacy, and respect integral to LegacyPass.

7. User Content

7.1 Ownership and Control

You retain ownership of all content you upload, store, or share within LegacyPass ("User Content"). LegacyPass does not have access to, nor does it claim ownership of, your User Content. You are solely responsible for ensuring that your User Content is accurate, lawful, and in compliance with these Terms.

7.2 Data Security

LegacyPass employs advanced encryption and security measures to protect your User Content. While we strive to maintain the highest security standards, we cannot guarantee absolute security. You are responsible for maintaining backups of your User Content.

7.3 Sharing User Content

You may choose to share your User Content with trusted contacts or beneficiaries. By sharing your User Content, you grant those individuals access to the specific information or files you designate. LegacyPass is not responsible for how your User Content is used by others once it has been shared.

8. Intellectual Property

All intellectual property rights in the App and Website, including but not limited to software, designs, logos, and trademarks, are owned by ITRUSTLEGACY LTD or its licensors. You may not use, reproduce, or distribute any content from the App or Website without our prior written consent.

9. Termination

LegacyPass reserves the right to suspend or terminate your account and license to use the App at any time for any reason, including but not limited to violation of these Terms, inactivity, or fraudulent activity. Upon termination, you will lose access to your account. LegacyPass will retain encrypted User Content for up to 30 days, after which it will be permanently deleted unless required otherwise by law.

10. Limitation of Liability

To the fullest extent permitted by law, ITRUSTLEGACY LTD shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of LegacyPass, including but not limited to loss of data, loss of profits, or interruption of service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of LegacyPass shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, you may have additional rights under the laws of your own country, and these Terms do not limit any such rights that cannot be waived under local law.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this document. For significant updates, such as changes to subscription terms or core feature functionality, we will notify users via email or in-app notifications. Your continued use of LegacyPass after any changes to these Terms constitutes acceptance of those changes.

13. Translations

LegacyPass is currently available in English. In the future, we may introduce additional language options within the App and on the Website for your convenience. Please note that any legal terms, including these Terms & Conditions, will be provided in English. If there is any discrepancy between the translated content within the App or Website and the English version, the English version shall prevail and be the binding version.

14. Referral Program (Future Use)

While LegacyPass currently does not have an active referral program, we may introduce one in the future. If a referral program is implemented, participation will be subject to specific terms and conditions that will be outlined at that time. Any personal data collected as part of the referral program will be handled in accordance with our Privacy Policy.
